Frequently Asked Questions
What Is Just Compensation?
An appraisal may consider more than the area physically acquired. Depending on the assignment and applicable law, valuation may involve the larger parcel, property rights taken, improvements, easements, temporary use, remainder damages, and benefits. Poseidon provides valuation services, not legal advice.
What Is a Partial Taking?
A partial taking occurs when a public project acquires only part of a property or certain rights in it. The valuation question often includes both the part acquired and whether the project changes the market value of the remainder.
What Is Before and After Valuation?
The property is analyzed immediately before the acquisition and the remainder is analyzed after the acquisition and project, under the applicable assignment assumptions. The difference may capture the value of the acquisition together with supported damages or benefits.
